AI Transparency Notice

1. AI Systems We Use

Scale Media AI is an AI-powered content creation platform. We use artificial intelligence throughout our Service to generate social media content tailored to your brand identity. In the interest of transparency and in compliance with the EU AI Act, we disclose the following:

1.1 Text Generation

We use large language models (LLMs) provided by Google (Gemini API) and, as a fallback, models accessed through OpenRouter to generate social media captions, hashtags, content calendars, and posting strategies. These models process your Brand Brain data — including your brand name, industry, tone of voice, and content preferences — to produce personalized text outputs.

1.2 Image Generation

We use AI image generation models (accessed via Google Gemini) to create visual content for your social media posts. These images are generated based on your Brand Brain, visual calibration preferences, and specific post context. All images produced by the Service are AI-generated unless you upload your own media.

1.3 Brand Intelligence (Taste Intelligence Engine)

Our proprietary Taste Intelligence Engine processes your onboarding inputs — including visual calibration swipes, anti-style selections, reference assets, and brand data — to build a structured Brand Brain. This is a personalization profile, not a profiling system as defined under GDPR Article 22. It does not produce legal effects or similarly significantly affect you.

2. AI Risk Classification

Under the EU AI Act's risk-based classification framework, Scale Media AI's use of AI systems falls into the limited risk category. Our AI systems:

• Do not make autonomous decisions with legal or similarly significant effects on users.
• Do not perform biometric identification, social scoring, or emotion recognition.
• Do not operate in high-risk domains such as healthcare, law enforcement, education, or employment.
• Generate content that is always subject to human review and approval before publication.

As a limited-risk AI system, our primary obligation is transparency — ensuring users know they are interacting with AI-generated content. This notice fulfills that obligation.

3. Human Oversight & Control

Scale Media AI is designed with human-in-the-loop principles:

• All AI-generated content (text and images) is presented as drafts for your review. Nothing is published without your explicit approval.
• You can edit, refine, regenerate, or reject any AI output before publishing.
• You control which social media platforms receive content and when it is published.
• You can modify your Brand Brain at any time by updating your brand profile, running a new visual calibration, or adjusting your preferences.
• You can disconnect social media accounts and delete your account at any time.

4. No Automated Decision-Making

In accordance with GDPR Article 22, we confirm that Scale Media AI does not engage in solely automated decision-making that produces legal effects or similarly significantly affects you. The AI generates content suggestions only. All decisions regarding content approval, editing, scheduling, and publishing are made by you.

5. Data Processing for AI

To generate personalized content, our AI systems process the following data:

Your data is not used to train third-party AI models. Prompts sent to Google Gemini and OpenRouter are processed in real-time and are not retained by these providers for model training purposes, as per our data processing agreements.

6. Limitations & Known Risks

AI-generated content has inherent limitations. You should be aware of the following:

• Accuracy — AI models may produce factual errors, hallucinated information, or misleading statements. Always fact-check AI-generated text before publishing.
• Originality — AI output may not be unique. Similar content may be generated for other users with similar inputs.
• Image resemblance — AI-generated images may inadvertently resemble real people, existing copyrighted works, or trademarks.
• Bias — AI models may reflect biases present in their training data, which could appear in generated content.
• Consistency — AI output quality may vary as underlying models are updated by their providers.

You are solely responsible for reviewing, editing, and approving all AI-generated content before publication. Scale Media AI accepts no liability for consequences arising from published AI-generated content. See our Terms of Service (Sections 10, 12, 13) for full details.

7. Your Labeling Obligations

Under the EU AI Act, content that is AI-generated may need to be labeled as such when published, particularly when:

• It could be mistaken for human-created content.
• It depicts realistic-looking images of people, places, or events that did not occur.
• It is used in contexts where the audience would reasonably expect human authorship.

It is your responsibility to comply with applicable AI content labeling requirements in your jurisdiction when publishing content created through the Service. We recommend clearly disclosing the use of AI-generated content where required or appropriate.

8. Third-Party AI Providers

We rely on the following third-party AI service providers:

We maintain data processing agreements with all AI providers. These agreements ensure that your data is processed only for the purpose of providing the Service and is not used for model training or any other purpose.

9. Your Rights

In relation to AI processing, you have the right to:

• Know that you are interacting with AI-generated content (this notice).
• Access information about how AI processes your data.
• Object to AI processing of your data (by deleting your account).
• Request human review of any AI output before it is published (which is the default behavior of the Service).
• Delete your Brand Brain and all associated AI-processed data.

10. Changes to This Notice

We may update this AI Transparency Notice as the EU AI Act implementing rules evolve and as our AI systems change. We will notify you of material changes by updating the "Last updated" date and, where appropriate, by notifying you via email.
