Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("AUP") defines the permitted and prohibited uses of the Scale Media AI platform ("Service"). This policy supplements and is incorporated into our Terms of Service. By using the Service, you agree to comply with this AUP.

2. Permitted Uses

The Service is designed for legitimate business and personal branding purposes. Permitted uses include:

  • Creating AI-generated social media content for your own brand or a brand you are authorized to represent.
  • Scheduling and publishing content to your connected social media accounts.
  • Using the Taste Intelligence Engine and Brand Brain to personalize your content output.
  • Uploading brand assets (logos, images, references) that you own or have the right to use.
  • Refining and editing AI-generated content before publication.

3. Prohibited Content

You must not use the Service to create, generate, publish, or distribute content that:

  • Is illegalViolates any applicable local, national, or international law or regulation.
  • Is harmful or abusivePromotes violence, terrorism, self-harm, or exploitation of any kind, including child exploitation.
  • Is hateful or discriminatoryTargets individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
  • Is defamatory or misleadingContains knowingly false statements that damage the reputation of individuals or organizations.
  • Is deceptiveConstitutes fraud, phishing, scams, or intentional misinformation, including the creation of deepfakes intended to deceive.
  • Infringes intellectual propertyViolates copyrights, trademarks, patents, trade secrets, or other proprietary rights of third parties.
  • Is sexually explicitContains pornography, non-consensual intimate imagery, or sexually exploitative material.
  • Is spamConstitutes unsolicited bulk messaging, chain letters, or automated mass posting designed to mislead or manipulate platform algorithms.
  • Violates privacyExposes personal data of third parties without their consent, including doxxing or unauthorized surveillance.
  • Impersonates othersFalsely represents your identity or affiliation, or creates content impersonating real individuals without authorization.

4. Prohibited Activities

You must not engage in the following activities on or through the Service:

  • Reverse engineeringAttempting to decompile, disassemble, or reverse-engineer any part of the Service, including the Taste Intelligence Engine and Brand Brain algorithms.
  • Circumventing restrictionsBypassing, disabling, or interfering with rate limits, credit systems, usage quotas, authentication, or any security or access controls.
  • Unauthorized accessAccessing accounts, data, or systems that do not belong to you, or assisting others in doing so.
  • Automated abuseUsing bots, scrapers, or automated tools to access the Service beyond normal use, or to extract data at scale.
  • ResellingReselling, sublicensing, or white-labeling the Service or AI-generated outputs without our prior written consent.
  • InterferenceDeliberately disrupting, overloading, or degrading the Service, its infrastructure, or the experience of other users.
  • Data miningUsing the Service to collect, aggregate, or mine data for purposes unrelated to your authorized use of the Service.
  • Unauthorized brand scrapingSubmitting third-party websites or social media profiles that you do not own or have authorization to use (see Terms of Service, Section 5.4).

5. Platform Compliance

When publishing content through the Service to third-party social media platforms, you are responsible for complying with the terms of service, community guidelines, and content policies of each platform, including but not limited to:

  • Facebook / Meta Community Standards
  • Instagram Community Guidelines
  • LinkedIn Professional Community Policies
  • X (Twitter) Rules and Policies
  • Threads Community Guidelines

Scale Media AI is not responsible for any consequences arising from content that violates third-party platform policies, including account suspension, content removal, or penalties imposed by those platforms.

6. Your Responsibilities

  • You are solely responsible for all content published through your account, including AI-generated content that you have approved.
  • You must review all AI-generated content for accuracy, appropriateness, and legal compliance before publishing.
  • You must ensure that all content complies with applicable AI content disclosure requirements (see our AI Transparency Notice).
  • You must not use the Service to violate any applicable data protection laws, including GDPR.
  • You are responsible for maintaining the security of your account credentials.

7. Enforcement

We reserve the right to take the following actions at our sole discretion, without prior notice, if we determine that you have violated this AUP:

  • WarningIssue a written warning and request corrective action.
  • Content removalRemove or disable access to content that violates this policy.
  • SuspensionTemporarily suspend your access to the Service.
  • TerminationPermanently terminate your account without refund.
  • Legal actionReport violations to law enforcement or regulatory authorities and pursue legal remedies where appropriate.

Enforcement decisions are final and are not subject to appeal unless otherwise required by applicable law. See our Terms of Service (Sections 5.3 and 19) for additional details.

8. Reporting Violations

If you become aware of any use of the Service that violates this AUP, please report it to us at info@scalemedia.ai with the subject line "AUP VIOLATION REPORT". Please include a description of the violation and any supporting evidence. We will investigate all credible reports and take appropriate action.

9. Changes to This Policy

We may update this Acceptable Use Policy from time to time. Material changes will be communicated via email or through a prominent notice on the Service. Continued use of the Service after changes constitutes acceptance of the revised policy.

AI Disclosure Compliance

Generated images delivered through the Service have embedded provenance metadata (such as C2PA Content Credentials and EXIF/XMP tags) removed during a standard re-encoding step. As the publisher, you are solely responsible for complying with any AI-disclosure obligations that apply to the content you post:

  • follow the EU AI Act, election laws, and other applicable laws that require synthetic content to be labeled as AI-generated;
  • follow the platform rules of any service you publish to (Meta, LinkedIn, X, TikTok, etc.) regarding AI-generated, manipulated, or synthetic media;
  • where required, enable the in-app "Add AI Disclaimer" option so a textual notice is appended to the caption — and add any further disclosure your jurisdiction or platform requires.

9a. Public Demo Page

When you use our public demo at scalemedia.ai/demo, every rule above applies, with one additional condition: you may only submit URLs that you own, operate, or have been explicitly authorized by the owner to submit for content analysis. Submitting URLs you do not own or are not authorized to use is a material breach of these terms and may trigger indemnification obligations under our Terms of Service. We record every submission (IP, user-agent, URL, timestamp, exact consent text) for up to 12 months as evidence of acceptance; full detail in our Privacy Policy.
